Terms & Conditions

Definition and Interpretation
 
Terms and Conditions may only be varied with the written agreement of MK CLEANING SERVICES & PROPERTY MAINTENANCE LTD herein referred to as “the Company”. These Terms and Conditions shall apply to all contracts for the supply of Services by the Company. Clients are herein referred to as “the Customer” to the exclusion of all other terms and conditions including any terms and conditions which the Customer may purport to apply under any purchase order confirmation of order or similar document.
“Agreement” means the agreement between the Company and the Customer incorporating the Agreement for the Supply of Goods and/or Services and these Terms and Conditions (including any relevant Purchase Order).
“Services” or “Job” means the services to be supplied by the Company to the Company as specified in the Agreement.
“Information” means site drawings and or information provided by the Customer to the Company communicated either verbally, by post or by email.
“Price” means the charges, taxes and disbursements specified by the Company in either the Agreement for the Supply of Goods and/ or Services.
“Site” refers to the location which will be subject to the delivery of services on behalf of the Customer. Clause headings shall not affect the interpretation of these Terms and Conditions
 
Quotation Acceptance
 
By accepting this quotation, you are entering an agreement whereby the Company shall provide the services at the price specified in the aforementioned quotation. This quotation may be subject to change if the information provided by the Customer is deemed inaccurate or unusable. Inaccuracies provided in information may result in extra work to be carried out and will affect the price
levied by the Company at its discretion (see also 6. Site Variations, 8. Right of Cancellation, 9. Temporary Postponement of a job and 9. Abortive costs).
 
Definition of the working day
 
This quotation applies to daytime week day working. Daytime week day working is defined as Monday to Friday between the hours of 7:30AM and 5:30PM herein referred to as “the Working Day”. All services provided that do not fall under the Working Day will result in extra charges being levied by the Company.
Weekend working is defined as Saturday and Sunday between the hours of 8:00AM and 5:00PM defined as “Weekend working”. All services rendered under Weekend Working will result in additional charges being added to the total price. The Company does not schedule or carry out work on Bank Holidays where a bank holiday may conflict with the Working Day. Normal office hours of the Company are Monday to Friday between the hours of 8:00AM and 5:00PM herein referred to as “Office Hours”.
 
Site Conditions
 
Pertaining to the Site, all working areas and surfaces must be clear of restricting items and large loose debris of any kind. This includes pallets, traffic, vehicles, plant equipment and personnel on the job commencement date. The Site must be ready for the works to be carried out, with either information agreed prior to the Agreement and in our possession or on Site as instructed by an agent of the Customer or a verbal instruction. Be aware that extra work may result in an extra charge levied by the Company at its discretion (see 6. Site Variations).
 
Site variations
 
Where possible, our site supervisor will obtain a site signature for any variation of work received on site. This may include extra work not previously quoted and will be treated as an extra job. This may include extra work due to inaccuracies in information provided by the Customer. Extra works or site variations will be charged at reasonable and competitive rates in addition to the services in the aforementioned quotation.
 
Payment Terms Domestic / Resedential 
 
Our terms of buisness are strictly Payment on completion of work / Date of invoice and payment must be made to The Company within this period.
 
Failure to Pay Domestic / Resedential 
 
 
By accepting our quotation either by means of a purchase order, confirmation email or letter, you are agreeing to paying no later than on completion of work / date of invoice  and accepting to pay 2.5% increase per week on to total invoice amount, the company deem any direct employ of the customer to be eligible to accept the above terms.
 
 
Payment Terms Commercial / Industrial 
 
Our terms of business are strictly 30 days net and payment must be made to the Company within this period.
Payment can be made by BACS only. Additional charges are applied after 30 days at a rate of 8% above the bank of England base rate of the total invoice plus VAT.
 
Failure to pay Commercial / Industrial
 
By accepting our quotation either by means of a purchase order, confirmation email or letter, you are agreeing to paying no later than 30 days from invoice date, and accepting to pay 2.5% increase per week on to total invoice amount, the company deem any direct employ of the customer to be eligible to accept the above terms.
 
Right of cancellation
 
Once an agreement has been made, we will require seven (7) working days’ notice of cancellation in writing only. A job is not considered cancelled unless your cancellation instruction is received either by email or post during Office Hours.
Any job which is cancelled under the seven (7) day notice period will be charged by The Company in regard to costs incurred. i.e. If it is impossible for the company to re-arrange other work for the time slot programmed, a charge of 25% of the contract NET value plus VAT will be charged.
The Company reserves the right to cancel any job when it is considered that inclement weather conditions are forecast making the job impossible due to poor surface conditions or poor driving conditions such as Snow, Frost, Rain or extreme wind.
The Company will accept NO financial responsibility for this.
The Company cannot be held responsible for job interruptions due to circumstances that are out of our control. Should this occur, the full quotation/job value may still be payable if the job is cancelled at this point.
 
Temporary Postponement of a job
 
Any job which is postponed under the seven (7) day notice period may be liable by The Company in regard to costs incurred. i.e. If it is impossible for the The Company to re-arrange other work for the time slot programmed, a charge of 25% of the contract NET value plus VAT may be charged. However, as the job has not been completely cancelled, any charge is at the discretion of The Company management. Wherever possible, The Company will try to waive the charge.
 
Abortive Costs
 
Should The Company arrive on The Site or be travelling to The Site on the allotted programmed day of the works and for any reason not attributable to The Company, the job cannot be started, or is cancelled, or it is postponed, then a mobilisation charge of 80% of the contract value will be charged. Should the job be postponed due to difficulties on The Site, delaying commencement, then an immediate telephone call must be made to The Company on 07773 560 582 during Office Hours to establish the delay and a course of action to be agreed. Whatever the problem, we will always try to work with our clients to resolve the problem(s).
11 Site Inductions
MK Cleaning Services & Property Maintenance Ltd take the necessity and legal requirement of site inductions and Health and Safety to all parties concerned very seriously. Whilst we appreciate the importance of site inductions we consider that given the nature of our works being mainly external cleaning services, that inductions should be limited to a maximum time frame of one hour. This would enable the issue of site ID badges, work permit(s) induction and ‘signing in’ procedures. We would require additional costs each hour after this time. the company also expects site inductions to be carried out on time, late site inductions are deemed job interruption and such work is chargeable.
Should our/their client require more time than one hour for inductions, this would impact on our job viability and as such, would incur a standing charge of £100 per MK Cleaning Services & Property Maintenance Ltd vehicle for any part of the first hour or any part of one hour thereafter.
 
Retentions/MCD/CiS (Main Contractors Payments)
 
Retention deductions and Main Contractors Discount will form no part of our contract and therefore, should these monies be deducted from the Company payment remittance, we insist that such payments be reimbursed to the Company within a seven (7) day period.
The company does not participate in CiS charges for any external cleaning works, or internal works which are not deemed building sites. Also, please see Clause 1. Definition and Interpretation
 
Downtime
 
Please see clause 5 to be used in conjunction with this clause. Should the Company operatives not be able to work for any reason, i.e. vehicles not moved/obstructions on site, skips, plant etc, personnel/traffic management not in place or not deemed safe by the Company and where applicable, pallets and or large debris on surface. There will be a standing charge of £100.00 for every MK Cleaning Services & Property Maintenance Ltd vehicle for any part of the first hour or and part of one hour thereafter.
